In light of the recent arrest made in Florida of a man caught “stealing” WiFi from a residential location (which I posted about a few days ago), CNET has posted an FAQ with several legal scholars about the implications of the case and what the laws already say.
The law that is most commonly used in Wireless hacking cases is the Computer Fraud and Abuse act, which was written in 1986.
The thing that is interesting about this case is that the “hacker” wasn’t really trying to steal anything (from the reports that I have seen), he was just using the connection.
It will definitely be interesting to see how this case plays out and what sort of precident it sets for future cases.
