Suit filed over Nano scratches

Well it looks like people are really getting up in arms about the whole “too easy to scratch” issue with the iPod nano, as they have gone as far as creating a class action law suit against Apple.

Not only do they want to be reimbursed for their purchase, but they also want an unspecified amount for statutory and punitive damages.

Claiming that the iPod Nano has a widespread propensity for scratching easily, lawyers this week filed a class action suit against Apple Computer on behalf of those who have purchased the diminutive music player.

The lawsuit, filed Wednesday on behalf of all those who have bought a Nano, alleges that Apple violated state consumer protection statutes, as well as express and implied warranties. The complaint charges that Apple knew that there were design problems with the Nano.

“These Nanos scratch excessively during normal usage, rendering the screen on the Nanos unreadable,” according to the complaint, which was filed in U.S. District Court in San Jose, Calif., by attorneys with Hagens Berman Sobol Shapiro in Seattle and Columbus, Ohio-based David P. Meyer & Associates. The suit seeks to have the complaint certified as a class action claim and asks for “damages in the amount of monies paid for Nanos,” as well as unspecified actual, statutory and punitive damages.

I know someone is about to say, ‘they should have bought a cover or sleeve’!!! But I recently started wondering: What’s the point of buying a product so damn beautiful–when you have to cover up all the time? What’s the point of buying a product so amazingly slim–when it doubles in width with a mandatory sleeve? And we all know that an ipod naked for a couple of months is as visually attractive as goatse.

And i’m really not trying to flaimbait (I’ve owned 3 ipods). It’s just an honest thought I had recently when considering the nano.

I’m with cliche and everyone else also. I really like my PSP but in terms of dusts, scratches and fingerprints it’s completely awfull. I had to buy a screen protector and I have to carry it around inside it’s little bag all the time. On the first day I got a small “dot” dent near the D-Pad and I didn’t do anything special and it was inside it’s bag.

My Sony Laptop on the other hand has wonderfull material, the case is very hard and so far there has been no scratches whatsoever on it and I handle it the same way I do my PSP, perhaps even with a little less care (Since my PSP has “two” protections, it’s sleeve bag and the laptop bag itself).

I saw an Apple Powerbook, and it’s surface was all scratched, it looked horrible, like it had been rubbed against a wall or something. I don’t think it only happens to an iPod.

Companies should choose hard and durable materials for their gadjets, specially those that you carry in your pockets. I hate Nokia’s cases, the case can survive a World War but the screen get’s scratched like I meant to do it or even breaks sometimes.

I’ve had 2 Nokia phones and around 8 “skins” in total, not to mention the various bags and covers I’ve tried for them. I like a gadjet that I can pick up and use quickly, not unwrap it like it was a mummy to finally see it’s shiny plate and start using it.

Bullshit. Form and function are not exclusive or. They complement eachother. You may be happy with your k-mart clothes because they’re just as functional as designer clothes. You may be happy with your wall-mart furniture because they’re just as functional as more expensive furniture. But some of us care about aesthetics as well as function.

So please, spare me the snobby “I care absolutely nothing about it’s looks” bullshit. People outside of your k-mart circle appreciate beauty.
